RUCIP - Rules & Practices of the Inter-European Trade in Potatoes

Costs

1. Fee:

  • € 250,- (every country has the right to reduce the allowance for local experts)
  • + € 30,- per hour (including travelling hours; € 300,- per day)

2. Board:

  • € 25,- per meal (max 2 meals / day)

3. Lodging:

  • € 100,- per hotel / accommodation

4. Travelling expenses:

  • by train: first class, (according to bills)
  • by airplane: tourist class (according to bills)
  • by car: € 0,40 per km

Every country holds the right to diminish the remunerations for the national experts and to justify this reduction to the European RUCIP Committee.

RUCIP Valuation Offices: € 150,- + in case of withdrawn demand of expertise, 50 % of the fee to pay for the expertise, still has to be paid.

1. Fee

a) pro rata of the value of the claim:

1st degree 2nd degree foreign arbitrator
< € 50.000 € 300,- + € 100,- + € 200,-
€ 50.000 – € 250.000 € 450,- + € 100,- + € 200,-
> € 250.000 € 600,- + € 100,- + € 200,-

Every country has the right to reduce the allowance for local arbitrators and to justify this  reduction to the European RUCIP Committee.

b) arbitration withdrawn before the meeting of the Arbitration Committee:

  • before sending the dossier to the arbitrators:
    20% of the mentioned fee + expenses
  • before the meeting of the arbitrator commission:
    50% of the mentioned fee + expenses

2. Board, lodging and travelling expenses according to bills

Travelling expenses:

  • by train: first class (according to bills)
  • by airplane: tourist class, if possible (according to bills)
  • by car: € 0,40 per km

Arbitration, 1st degree

1. Fee (pro rata of the value of the claim):

  • < € 5.000: € 420,-
  • ≥ € 5.000: € 720,-
  • ≥ € 15.000: € 960,-
  • ≥ € 25.000: 3% with a minimum of € 1000 and a maximum of € 20.000

2. Expenses of the competent Secretariat (postal fees, award translation, room rental for the hearing, other costs, etc.)

3. Arbitrators fees and expenses 

 

Arbitration, 1st degree, but withdrawn:

a) before the selection of the arbitrators takes place:

  • 20% of the remunerations mentioned under 1 + expenses

b) before the meeting of the Arbitration Committee takes place:

  • 50% of the under 1. mentioned remuneration + expenses

The same calculation applies for the fees and expenses of the arbitrators.

 

Arbitration, 2nd degree:

  • The fee of the 1st degree is doubled, 50% is paid to the European Committee.
  • The expenses of the competent Secretariat and the arbitrators’ fees and expenses are added.
  • The same rule as for arbitrations in 1st degree applies in case an arbitration in 2nd degree is withdrawn.
